Public offer (user agreement)
Version of ____
1. General provisions
1.1. This document is a public offer by ____, tax/registration number ____, address: ____ (the "Administrator") to enter into an agreement on the use of the YouGive.Me service at https://yougive.me (the "Service") on the terms below, in accordance with Articles 633, 641 and 642 of the Civil Code of Ukraine.
1.2. Registering on the Site and ticking "I accept the offer and the rules" means full and unconditional acceptance of this offer. If you do not agree with the terms, do not use the Service.
1.3. The Service may be used by persons aged 18 or over with full legal capacity.
2. Definitions
User — a registered person. Customer (Sender or Passenger) — a User who wants to send a parcel or ride along. Carrier (Driver) — a User who has passed the document check and takes parcels or passengers.
Deal — an agreement between a Sender and a Carrier to deliver a parcel. Booking — an agreement between a Passenger and a Driver about a ride. Declared value — the value of the parcel contents stated by the Sender. Handover code — a 4-digit code the recipient gives the Carrier at delivery. Tracking number — a Deal number of the form YG-XXXX-XXXX.
3. Subject of the agreement
3.1. The Administrator gives Users access to an online platform where they find each other, agree on parcel delivery and shared rides, chat, leave reviews and resolve disputes through support.
3.2. The Service is an information intermediary. The Administrator is not a carrier, freight forwarder, postal operator or taxi service and does not accept parcels or passengers. The contract of carriage or commission is concluded directly between Users, and they are solely responsible for performing it.
4. Registration and verification
4.1. A User provides accurate information and confirms their email and phone number. One phone number — one account.
4.2. A Carrier uploads photos of their passport or ID card, driving licence, vehicle registration and car. A moderator checks them manually. A Customer may optionally confirm their identity with an ID document and a selfie to get the "Identity verified" mark.
4.3. After the moderator's decision, document photos are deleted from the server. Only the car photo, shown to passengers, is kept.
4.4. Verification confirms that the documents were presented and looked genuine at the time of the check. It does not guarantee the User's good faith in the future.
5. How a Deal works
5.1. The Sender publishes a parcel: route, deadline, description, weight, declared value and price. Carriers offer a price no lower than stated, and the Sender chooses one offer. The Deal gets a tracking number.
5.2. At handover the Carrier inspects the contents and may refuse the parcel if it does not match the description, contains prohibited items or the Sender does not allow it to be opened.
5.3. Delivery is confirmed with the code the Sender gives to the recipient. The Carrier is not told the code in advance.
5.4. If the delivery deadline has passed and delivery is not confirmed, the Service notifies the parties and support.
5.5. Rides: the Driver confirms the booking and the Passenger gives the code at the end of the ride. The Passenger may cancel the booking before departure.
6. Payment and commission
6.1. The price of a Deal or Booking is set by the Users. For the use of the Service the Administrator receives a commission of 7 % of the Deal or Booking amount. The commission is deducted from the payout to the Carrier or Driver; the Customer pays exactly the agreed price.
6.2. Where payment through the Service is enabled, the Customer's money is held by a payment partner (a bank or payment system) until the parcel is delivered or the ride ends, and is then transferred to the Carrier minus the commission. The Administrator is not a bank and does not store card details.
6.3. If a Deal is cancelled before handover, or a Booking before departure, the Customer gets a full refund and no commission is charged. Refund times to a card depend on the bank.
6.4. If Users pay each other directly, bypassing the Service, the Administrator is not responsible for such payments.
7. Obligations of the Sender and Passenger
7.1. Describe the parcel honestly and state its real declared value, not send prohibited items (see "Rules" and "What you can carry across the border"), pack the parcel securely and let the Carrier inspect it.
7.2. Give the handover code only to the recipient.
7.3. The Sender is responsible for the parcel contents, including before customs and law enforcement, if the contents do not match the description.
7.4. The Passenger keeps to the agreed place and time, the ride rules and safety.
8. Obligations of the Carrier and Driver
8.1. Hold a valid driving licence, vehicle documents and insurance, and follow traffic rules.
8.2. Inspect the parcel at handover, keep it safe and deliver it by the agreed deadline, and not open it after handover without need.
8.3. Follow customs rules, declare what must be declared and not carry prohibited items.
8.4. The Carrier is liable to the Sender for loss of or damage to the parcel after receiving it, up to the declared value, unless they prove the damage was not their fault (for example, hidden packaging defects or a customs decision caused by the parcel contents).
9. What the Administrator is responsible for
9.1. Keeping the Site and the functions described in this offer working and fixing failures within a reasonable time.
9.2. Checking Carriers' documents as described in section 4.
9.3. Where payment through the Service is enabled — holding, paying out and refunding money through the payment partner according to the Service rules and support decisions.
9.4. Reviewing disputes and complaints within 10 business days of receiving both parties' explanations.
9.5. Processing and protecting Users' personal data as required by law (section 12).
10. What the Administrator is not responsible for
10.1. Users' actions or omissions, the accuracy of their descriptions and reviews, or the quality and timing of agreements between them.
10.2. Parcel contents, loss, damage or delay — the Sender and Carrier are responsible for these under sections 7 and 8.
10.3. Decisions of customs, border and other authorities: inspection, detention, confiscation, fines and duties.
10.4. Road accidents and harm to life, health or property during a ride.
10.5. Outages of communications, payment systems, hosting and other circumstances beyond the Administrator's control, including those caused by martial law.
10.6. Lost profits and indirect losses.
10.7. In any case, the Administrator's liability is limited to the commission it received for the relevant Deal or Booking.
11. Disputes
11.1. A dispute is opened on the Deal or Booking page. While it is open, the money stays on hold.
11.2. Support resolves the dispute based on the chat in the Service, photos, the tracking number and the parties' explanations: it refunds the Customer, pays the Carrier or continues the Deal.
11.3. If the parties disagree with the decision, the dispute is settled through negotiation and, failing agreement, in court under the laws of Ukraine.
12. Personal data
12.1. The Administrator processes the name, email, phone number, Deal data and chats to run the Service, and document photos only for verification, in accordance with the Law of Ukraine "On Personal Data Protection".
12.2. The phone number is visible only to the other party of a Deal or Booking. Documents are seen only by moderators and are deleted after the check.
12.3. A User may request access to their data, its correction or deletion of the account by writing to admin@yougive.me. Deal data may be kept as long as the law requires.
13. Blocking
13.1. The Administrator may restrict or block an account for breaching this offer or the Rules: fraud, carrying prohibited items, insults, bypassing payment through the Service, forged documents.
14. Changes to the offer
14.1. The Administrator may change the offer by publishing a new version on the Site. The new version applies from publication. Deals and Bookings created before the change are performed on the previous terms.
15. Administrator details
____, tax/registration number ____, address: ____, email: admin@yougive.me.
